PREAMBLE :

The general terms and conditions of sale are concluded between the seller (Un Ours en Ville) and any person wishing to make a purchase via this website, hereafter, the buyer. By validating his order, the Customer declares to accept without reserve the terms of the order as well as the entirety of the present general conditions of sale and declares to have the capacity to conclude a contract with the seller.

1- PURPOSE

The present conditions of sale aim at defining the contractual relations between the salesman and the purchaser as well as the conditions applicable to any purchase carried out by the means of this commercial site. The present conditions of sale will prevail over any other general or particular conditions not expressly approved by the seller. The seller reserves the right to modify its general conditions of sale at any time without prior notice: the applicable conditions will be those in force at the date of the order by the buyer.

2- CHARACTERISTICS OF THE GOODS AND SERVICES OFFERED

The products or services offered are those presented on the present site and which are accompanied by a detailed description. These products and services are offered within the limits of available stocks and as long as they are visible on the site. In case of unavailability of the product or service after placing the order, the seller will inform the buyer by email: the order will be automatically cancelled and no debit will be made.

3- PRICES

The prices appearing on the present commercial site are understood to include all taxes (VAT + other applicable taxes) excluding processing and transport costs which are applied and detailed at the time of the order. The seller reserves the right to modify its prices at any time: the products and services are invoiced on the basis of the rates in force at the time of validation of the order, subject to availability. THE PRODUCTS REMAIN THE PROPERTY OF THE SELLER UNTIL THE COMPLETE PAYMENT OF THE PRICE.

4 - GEOGRAPHICAL AREA

The online sale of products and services presented in this site is reserved for buyers who reside in France and in Europe and for deliveries required in these geographical areas.

5- ORDERS

The buyer who wishes to buy a product or service online via the site must follow the online ordering process which includes an identification phase, a phase of verification and validation of the chosen products and services, a phase of payment under the conditions provided and a phase of confirmation of the order and payment. Confirmation of the order implies acceptance of these terms of sale, recognition of having full knowledge of them and waiver of its own conditions of purchase or other conditions. All the data provided as well as the recorded confirmation will be worth proof of the transaction. The seller will send by e-mail confirmation of the registered order which will be considered as acceptance of the order.

6- PAYMENT

The price is due at the time of order. Online payments are made by secure system so that no third party can have access to the data transmitted on this occasion.

7 - DELIVERY

Deliveries are made to the address indicated in the order form within the geographical limits specified above. THE RISKS ARE THE RESPONSIBILITY OF THE BUYER ONCE THE ORDER HAS LEFT THE SELLER'S PREMISES. Any protest relating to a damage occurred during transport must be formulated by complaint motivated, of which a copy will be addressed to the salesman, near the conveyor, within three days as from the delivery. The delivery times are given as an indication and include the treatment, the routing and the forwarding. The buyer has a right of cancellation in case of delay superior to 7 days, the refunding of the products or services and of the expenses outward journey being carried out with reception of the return of the complete order in its state of origin. The seller is not responsible in case of non-performance of the contract due to a case of force majeure (strike, fire, flood ...).

8- RETRACTION

The non-professional buyers have a seven-day retraction period from the delivery of their order to return the product to the seller for exchange or reimbursement without penalty (reshipment costs at their expense). The returns are to be made in the complete state of origin (packing, accessory, note...) allowing their remarketing in the new state and accompanied by a copy of the purchase invoice. This right does not apply to immediately reproducible unsealed products and to personalized products on request.

9- WARRANTIES

All products and services provided benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In case of non-conformity, it can be returned to the seller who will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made according to the procedures specified on the site, with a reasoned claim and a copy of the invoice, within thirty days of delivery.

10- RESPONSIBILITY

The seller, in the process of selling online, is bound only by an obligation of means. Its responsibility cannot be engaged for a damage resulting from the use of the Internet network such as losses of data, intrusion, virus rupture of the service or other involuntary problems, as well as any fact qualified as force majeure. The photographs accompanying the products are communicated for illustrative purposes but cannot ensure a perfect similarity, particularly with regard to colors. In case of doubt or for any additional information, it is advisable to contact the seller.

11- PERSONAL INFORMATION

Personal information is necessary for the management of orders and commercial relations. In accordance with the law relating to data processing, the files and freedoms of January 6, 1978, the information with personal character relating to the purchasers could be the subject of an automated treatment. The users have a right of access and of correction of the data concerning them, in accordance with the law of January 6, 1978.

12- INTELLECTUAL PROPERTY

All the elements of this site are and remain the exclusive intellectual property of the seller. Only the use for a private use is authorized. Any partial or total reproduction of all or part of the elements appearing on this site is prohibited. 13- SETTLEMENT OF DISPUTES. The present general conditions of sale are subject to French law. The language of this contract is French. In case of dispute, the French courts will have exclusive jurisdiction.
